1. Introduction These Terms and Conditions govern the collaboration between ApniPathshala and the POD for the establishment and operation of the Learning POD. By agreeing to this collaboration, both parties acknowledge and accept the following terms.
2. Purpose The Learning POD is established to enhance educational resources, promote digital literacy, and provide skill development opportunities for students in the community.
3. Roles and Responsibilities
ApniPathshala’s Responsibilities:
- Provide up to 10 computers and necessary peripherals on a 15-month lease basis.
- Offer training to POD staff or volunteers for effective utilization of resources.
- Conduct periodic assessments and provide technical support.
- Supply promotional materials to highlight the partnership.
POD’s Responsibilities:
- Allocate a dedicated space with necessary infrastructure such as electricity, internet, and seating arrangements.
- Appoint staff or volunteers to manage daily operations.
- Ensure the computers are used solely for educational purposes.
- Submit weekly video updates and performance reports.
- Maintain transparency in operations and student engagement.
- Promote the initiative within the community and display ApniPathshala branding prominently.
4. Financial Arrangements
- ApniPathshala will bear the cost of providing computers and initial training.
- The POD will be responsible for operational expenses, including utilities and internet.
- Any fees charged by the POD to students must be fair and used for maintaining educational quality.
5. Lease and Ownership of Equipment
- The computers remain the property of ApniPathshala and are leased to the POD for 15 months.
- ApniPathshala reserves the right to reclaim the computers if the POD fails to meet the agreement’s terms.
- Any intentional damage to equipment may result in immediate termination of the agreement.
6. Reporting and Evaluation
- The POD shall provide regular reports on student attendance, equipment usage, and program impact.
- ApniPathshala reserves the right to conduct inspections or evaluations at any time.
7. Confidentiality Both parties agree to maintain the confidentiality of any sensitive information shared during the partnership.
8. Term and Termination
- This agreement is valid for 15 months from the start date.
- Either party may terminate the agreement with 30 days’ written notice.
- Upon termination, the POD must return all equipment in good condition.
9. Dispute Resolution
- Any disputes will be resolved through mutual discussions or referred to mediation/arbitration under the applicable laws.
10. Publicity and Branding
- Both parties agree to collaborate on promotional activities.
- Any public announcements or press releases must be approved by both parties.
11. Indemnification
- Each party shall indemnify the other against any claims arising from a breach of this agreement or negligence.
12. Non-Exclusivity
- This agreement does not restrict either party from entering into similar collaborations with other organizations, provided there is no conflict with these terms.
13. Governing Law
- This agreement shall be governed by the laws of the respective country/state where the Learning POD operates.
By proceeding with this partnership, both ApniPathshala and the POD agree to abide by these Terms and Conditions.
